THE IBERIAN SEA SCHOOL
Your contract is with Martin Northey and The Iberian Sea School. When making your booking you agree that you accept these terms and conditions. A contract exists as soon as I have received your deposit and booking form, which you will have sent having received an email confirmation of your course price and dates from me. You should check the details of your confirmation carefully to ensure that it accurately reflects the booking you have requested and immediately inform me of any discrepancies. This contract is made on the terms of these booking conditions which are governed by Portuguese Law and we both agree to submit to the jurisdiction of the Portuguese Courts at all times.
Your Course Price: When making your booking you must pay a deposit of 25%. The balance is due 28 days prior to the commencement of your course. If the balance is not paid in time, I may cancel your booking and retain your deposit. Once you have booked, the agreed price of your course is fully guaranteed by The Iberian Sea School and you will not be subjected to any surcharge. This does not apply to invoice errors.
Cancellation Policy: Should you wish to cancel your booking, written notice is required. Any deposit paid will not be refundable, and you will be liable for 100% of the total cost of your course if less than 28 days notice is given. If for reasons of my ill health, death of a close relative, or my presence being required at a Portuguese Court as a witness or other equally important reason, a day, several days or possibly your entire course may have to be run by an alternative Instructor (if available) OR postponed to a mutually agreeable future date. If neither of these alternatives is acceptable to you, all the money that you have paid will be returned to you. In this event my responsibility for your course ceases and I will not be liable for any extra costs incurred by you.
Course Termination: I reserve the right at my absolute discretion to terminate without further notice the course arrangements of any client who refuses to comply with my instructions and whose behaviour in my opinion is likely to cause distress, damage, danger or annoyance to other clients, any third party or to property. Following termination for any of these reasons my responsibility for your course ceases, your course fee will not be refunded and I will not be liable for any extra costs incurred by you.
If you have a complaint or if you have a problem during your course, please inform me immediately, I will endeavour to put things right. If your complaint is not resolved during your course, please follow this up within 28 days of the end of your course by writing to me, giving details of your complaint or problem and all other relevant information. It is strongly suggested that you communicate any problem to me without delay. If you fail to follow this simple procedure I will have been deprived of the opportunity to investigate and rectify your complaint during your course or immediately following it and this may affect your rights under this contract.
Insurance cover: Motor cruisers, Yachts and Sports Boats provided by the school are comprehensively insured. Their policies provide third party cover but DO NOT cover individuals on board or their personal possessions. The Iberian Sea School, or any person subcontracted by The Iberian Sea School shall not be liable for loss or damage to clients’ property nor for any injury or illness suffered by any client for whatever reason or cause. I strongly recommend clients to have their own accident, travel and all risks insurance. When receiving instruction in your own boat it is imperative that firstly your boat is insured and secondly you inform your insurance company that you will be doing a course of instruction over specific dates and that they will give you cover for instruction during those days.
Restrictions: The Iberian Sea School is responsible for the safe conduct of your course and may vary the itinerary to that end. I will decide what activities are available, whether conditions are safe to use a craft, and/or a passage shall be made.
